Coal County Employee Fired for Wife’s Facebook Posts

A former Coal County employee showed up to work one day only to find that he was being fired because his wife had posted political statements about a county commissioner’s re-election efforts. SD&C Partner Preston Draper filed a complaint in Federal Court alleging that the employee was fired after being told “We are not going to pay you to work here when your wife is putting stuff on Facebook about the commissioner.” Draper is seeking back pay and punitive damages against the county and the commissioner because they violated the employee’s Freedom of Speech protected by the First Amendment.

Draper and other SD&C attorneys have previously filed and settled multiple suits on behalf of wrongfully terminated employees seeking back pay and other damages.

This suit was featured on the front page of the Coalgate Record Register on January 2, 2013.
